Article 3 – Applicability
These terms and conditions apply to every offer made by the seller and to every distance contract
and order concluded between the seller and the consumer.
Before the distance contract is concluded, the text of these terms and conditions will be made
available to the consumer. If this is not reasonably possible, it will be indicated that the terms and
conditions can be viewed at the seller's premises and will be sent free of charge at the consumer's
request.
If one or more provisions of these terms and conditions are null and void or annulled, the
remaining terms and conditions remain in force. Situations not covered by these terms and
conditions shall be assessed in the spirit of these terms and conditions.
Article 4 – The Offer
If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in
the offer. The offer is non-binding. The seller is entitled to change and adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered.
Obvious errors or mistakes in the offer are not binding on the seller. All images and specifications
are indicative and cannot give rise to compensation or dissolution of the agreement.
The price is exclusive of customs clearance costs and import VAT. These additional costs are at
the expense and risk of the customer. The postal or courier service will collect import VAT from
the recipient of the goods.
Article 5 – The Agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the moment the
consumer accepts the offer and fulfils the conditions set therein.
If the consumer has accepted the offer electronically, the seller will immediately confirm receipt
of the acceptance electronically. As long as the receipt of this acceptance has not been confirmed,
the consumer may dissolve the agreement.
The seller will take appropriate technical and organisational measures to secure the electronic
transfer of data. Every agreement is concluded under the condition that sufficient availability of
the relevant products exists.
Article 6 – Right of WithdrawalWhen purchasing products, the consumer has the right to dissolve the agreement without giving
reasons within 14 days. This cooling-off period begins on the day after the consumer, or a
representative designated by the consumer, has received the product.
During the cooling-off period, the consumer will handle the product and its packaging with care.
If the consumer wishes to exercise their right of withdrawal, they must notify the seller within 14
days of receiving the product via a written message or email.
After notifying the seller, the consumer must return the product within 14 days. The consumer
must provide proof that the goods were returned in time, for example by means of proof of
postage.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the return shipping costs are at the consumer's
expense. The seller will refund the purchase amount as soon as possible, but no later than 14
days after withdrawal, provided the product has been received back or conclusive proof of
complete return has been submitted.
Article 8 – Exclusion of Right of Withdrawal
The seller may exclude the consumer's right of withdrawal for products that:
• Have been created by the seller in accordance with the consumer's specifications
• Are clearly of a personal nature
• Cannot be returned by their nature
• Can deteriorate or expire quickly
• Are audio or video recordings or computer software of which the consumer has broken
the seal
• Are hygiene products of which the consumer has broken the seal
Article 9 – The Price
During the period of validity stated in the offer, the prices of the products and/or services will not
be increased, except for price changes resulting from changes in VAT rates. Price increases
within 3 months of concluding the agreement are only permitted if they result from statutory
regulations.
Delivery takes place outside the EU. The postal or courier service will collect import VAT and/or
customs clearance costs from the recipient. The seller will therefore not charge VAT. All prices
are subject to typographical and printing errors.
Article 10 – Conformity and WarrantyThe seller warrants that the products and/or services comply with the agreement, the
specifications stated in the offer, and the reasonable requirements of soundness and usability.
Any defects or incorrectly delivered products must be reported to the seller in writing within 14
days of delivery.
The warranty does not apply if the consumer has repaired or modified the products themselves,
the products have been exposed to abnormal conditions or careless treatment, or the defect is
wholly or partly the result of government regulations regarding the nature or quality of materials
used.
Article 11 – Delivery and Performance
The seller will take the utmost care when receiving and executing orders. Accepted orders will be
executed within 30 days at the latest, unless the consumer has agreed to a longer delivery period.
If delivery is delayed or if an order cannot be fully executed, the consumer will be notified no later
than 30 days after placing the order. In that case, the consumer has the right to dissolve the
agreement free of charge and may be entitled to compensation.
The risk of damage and/or loss of products rests with the seller until the moment of delivery to the
consumer.
Article 12 – Continuing Transactions: Duration, Termination and Renewal
The consumer may terminate an agreement concluded for an indefinite period at any time,
observing a notice period of no more than one month. An agreement for a fixed period may be
terminated towards the end of the agreed period, observing the agreed termination rules.
An agreement for a fixed period may not be tacitly renewed for a fixed duration, unless the
consumer may terminate at any time with a notice period of no more than one month. If an
agreement has a duration of more than one year, the consumer may terminate after one year with
a notice period of no more than one month.
Article 13 – Payment
Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 working days
after the start of the cooling-off period. The consumer has a duty to immediately report any
inaccuracies in payment details provided to the seller.
In the event of non-payment by the consumer, the seller has the right, subject to legal limitations,
to charge reasonable costs that have been communicated to the consumer in advance.
Article 14 – Complaints Procedure
Complaints about the execution of the agreement must be submitted to the seller fully and clearly
described within 7 days of the consumer discovering the defects.Complaints submitted to the seller will be answered within 14 days from the date of receipt. If a
complaint requires a longer processing time, the seller will respond within 14 days with an
acknowledgement of receipt and an indication of when the consumer can expect a more detailed
response. If a complaint is found to be justified, the seller will, at its discretion, replace or repair
the delivered products free of charge.
Article 15 – Disputes
Agreements between the seller and the consumer to which these terms and conditions apply are
governed exclusively by Dutch law, even if the consumer resides abroad.
